10th International Conference @Re:Source MAH
On September 16, 2023, Dr. Maja Bogataj Jančič participated in the event @Re:Source MAH – the 10th International Conference on Histories of Media Art, Science and Technology. The program was divided into various categories (“tracks”), specifically focusing on the documentation and preservation of media arts; climate change; pioneers of media arts; and the history of media arts in museums.
In her contribution, Dr. Bogataj Jančič focused on the right to research, reflected in the exceptions and limitations of exclusive copyrights, especially the general exception for research and particularly exceptions for data and text mining, as defined in Directive 2019/790 on copyright and related rights in the Digital Single Market. This Directive, transposed into the legal systems of member states, serves as the legal basis for training large data models, fundamental for generative AI. She presented the advantages and challenges that EU legislation brings to researchers and others, and also highlighted the associated economic-political challenges of generative AI.

The District Court of Hamburg ruled in the case of Kneschke v. LAION e.V. that LAION did not infringe the copyright of photographer Kneschke, as the use of his photograph was covered by the exception for text and data mining (TDM) for scientific purposes.
“Can copyright bring artificial intelligence to its knees? Which other circumstances may cause that the “making” of generative AI can dramatically change in the (near) future. This short paper presents potential challenges that copyright poses to the training of the machines on large amount of data. Different jurisdictions address these issues differently. In the USA the legality of these activities is tested in several court cases. Do gentlemen’s agreements and pragmatic symbiosis known from the “search engines business model” provide sufficient basis and/or incentive for the business model of “making” generative AI business model as well?
