Barriers and incentives in copyright law for open science
“Open science is a new approach to the scientific process, based on collaborative efforts and new ways of disseminating knowledge, improving access to and re-use of research results through digital technologies and new tools for collaboration”.
ODIPI, with the support of Knowledge Rights 21, will carry out a study analysing the provisions of the Copyright and Related Rights Act (ZASP) to identify those that hinder open science, i.e. those provisions that hinder the management of copyright through open licenses, e.g. Article 101 of the ZASP (Copyright Works of Employment), non-liability of remuneration provisions, etc. The study will also analyse the provisions of the ZASP to identify those that hinder open science. In cooperation with researchers from other countries, the findings will be extended to other legal systems. ODIPI will propose appropriate amendments to the ZASP to reduce or remove these obstacles. Open science can be supported by certain solutions in copyright legislation and ODIPI will propose appropriate amendments to the legislation to implement such provisions in the Republic of Slovenia.
