Webinar on “Copyright-legal basis for training generative AI”
Open Data and Intellectual Property Institute ODIPI is organising a webinar on the topic of text and data mining copyright exception, titled “Copyright-legal basis for training generative AI”, as part of the national and regional coordination of the Knowledge Rights 21 programme, led by Dr. Maja Bogataj Jančič.
The webinar, which will take place on Friday, 23 June 2023, will feature a presentation by a representative of the European Commission on the EU legislative framework, presentations by researchers from Slovenia and Croatia on the regulation in force in these two Member States, and presentations by researchers from other countries in the region on the legislation under development in their jurisdictions.

The webinar will start at 10 a.m. and end at 13 p.m. The last part, from 12.30 p.m. to 13 p.m., will take the form of a working discussion on current research in the field of data and text research among researchers in the region and will be closed to the public: we will discuss current research questions and possibly add new ones. The findings will be presented at the Open Knowledge Day conference, which will be held in the autumn, both live in Ljubljana and online.

ODIPI is organizing ERA KR21 Conference: Barriers and Incentives for Open Science in the Copyright Law that will take place on 2 December, 2024 at Hotel Four Points by Sheraton (Mons) in Ljubljana and also online.
The District Court of Hamburg ruled in the case of Kneschke v. LAION e.V. that LAION did not infringe the copyright of photographer Kneschke, as the use of his photograph was covered by the exception for text and data mining (TDM) for scientific purposes.
“Can copyright bring artificial intelligence to its knees? Which other circumstances may cause that the “making” of generative AI can dramatically change in the (near) future. This short paper presents potential challenges that copyright poses to the training of the machines on large amount of data. Different jurisdictions address these issues differently. In the USA the legality of these activities is tested in several court cases. Do gentlemen’s agreements and pragmatic symbiosis known from the “search engines business model” provide sufficient basis and/or incentive for the business model of “making” generative AI business model as well?
